The HPD Collaborative has developed and maintains the Health Product Declaration Open Standard. It is incorporated as a reporting tool in many leading certification programs, such as LEED v4 and WELL, and is also the foundation for industry harmonization efforts to establish a single method that can simplify reporting – and also improve the accuracy, consistency and reliability – of information about building products and health.

Q: What work is required for a brand to ensure that all qualified mM products are properly displaying on both mM & MB
A: First, make sure that you have properly listed all products on both databases. That includes requesting a mindful MATERIALS review for your completed and published Origin listings. Next, make sure the names of the materials on both sites match.
Q: What are the reasons that a mM product may not be displaying a mM link on a MB PDP?
A: The likely reason is that the materials are not properly connected. The answer is to ensure the material names are the same, the materials are live on both sites, and that enough time has passed (about 10 days) for the changes to take place (if any have been made). The integration runs approximately once per week. If all of these points have been accounted for, then the next best step is to reach out to your Material Bank account rep, or Laura Steele of Material Bank.
Q: What are the reasons that a mM product may not be displaying a MB sample now button on mM?
Q: How long does it take for a new product on mM to have the mM link displayed on MB?
A: Once the review process is complete and the materials are live on the mM site, it can take up to 7 days for the integration to complete.
Q: What if the name of both platforms is not exactly the same?
A: The more similar they are, the higher likelihood a match will auto complete. If all of the above points have been accounted for, then the next best step is to reach out to your Material Bank account rep, or Laura Steele of Material Bank.
Q: What if I have a general product family displayed on mM but individual SKUs on MB – where does the MB Sample Now button direct to?
A: The best next step is to reach out to your Material Bank account rep, or Laura Steele of Material Bank to ask for a manual review and integration.
Q: Do all the products that are both in mM & in MB have active links?
A: The integration is live and being continually updated. Where does material information found on Origin come from?
Material information comes from two primary sources: Manufacturers and integrations with Reporting Bodies. Manufacturers can provide product information by using Origin’s API services, spreadsheet import tools or by directly using the Origin application. Reporting Bodies provide product audits and certification data using Origin’s API or data integration services.Certification data and audits, provided by Reporting Bodies, can be linked to related Manufacturer materials. However, Manufacturers cannot edit information provided by Reporting Bodies.
Enable the "Data Source" filter when searching to see where information comes from. Data from Reporting Bodies is denoted with a circled "R". Data from Manufacturers is denoted with a circled "M". Data which is deduced by Origin intel is denoted with a circled "O".
What does “Data Source” mean?
“Data Source” refers to the organization who provides a particular data point. Origin integrates with several Reporting Bodies to connect directly to certifications, declarations and test reports. Thru these integrations, Manufacturers can connect their materials to content provided by various Reporting Bodies. Manufacturers cannot edit content which is provided by a 3rd party Data Source. Manufacturers also have the option to create their own content. In these cases, the “Data Source” will be listed as the Manufacturer.
How do I know if material information is verified?
The Origin Material Hub integrates with Reporting Bodies and Manufacturers to provide AEC users with material and certification data directly from its source. Manufacturers cannot edit data which is provided by Reporting Bodies - Manufacturers can only connect or disconnect reporting body data to their materials. When Reporting Body source data is updated, these updates appear in all materials that the updated certification or declaration is connected to. This provides great data management efficiencies for manufacturers, while ensuring data accuracy.
Manufacturers cannot attach green building credits to their materials - Origin's green building search filters are powered by the data which is provided, or by neutral 3rd-Party validation.
Manufacturers are encouraged to connect their materials to integrated Reporting Body information. Materials with connected certifications are prioritized in Origin's search results.

How often is information on Origin updated?
Manufacturers are not required to provide scheduled information updates. Manufacturers can update their material information at any time; changes are immediately displayed on Origin. Material information that is provided to Origin through API services also remains up-to-date as updates are received. At the bottom of each Material page, you will see the "Last Updated" date listed.
Why can’t Manufacturers pay to advertise their materials on Origin?
We believe strongly in protecting the quality of materials data that is found on Origin. We do not allow Manufacturers to advertise their products on Origin to maintain the integrity and trustworthiness of all material information. In addition, Manufacturers are not permitted to pay to increase their search ranking. Our search algorithm is primarily determined by information completeness - materials with the most relevant data, appear first in search results.
How can data be managed using the Origin Material Hub?
There are five ways to manage data use the Origin Material Hub.
Can Manufacturers use Origin for free?
Yes! Manufacturer account set-up is free on Origin. Manufacturers can connect to Origin's Import API services or add material portfolios directly on Origin for free. Manufacturers can also connect to integrated certifications for free. Submitting materials for inclusion in the mindful MATERIALS Library is also free.
Can AEC search Origin for material information for free?
Yes! Material information is freely searchable on Origin.
We believe strongly in providing free access to material information to encourage increased Manufacturer engagement and information disclosure.
What optional services can Manufacturers pay for?
Premium Account Licenses - Available to provide Manufacturers with advanced content management (CMS) tools, market communication features and data exchange tools. Manufacturers may also opt-in for custom services: advanced training, support and feature configurations.
Origin Analytics Packages - Provide intel specific to the growth and trends of the material transparency movement, aggregate user search habits, CSI division-specific details and geographical comparisons. Origin Analytics Packages help Manufacturers optimize their exposure on Origin and Origin connected Libraries (mindful MATERIALS, Sourced by Delos, Hines 1MP, etc.) and guide sustainability efforts.

What does it mean when a platform is "Powered by Origin"?
The Origin Material Hub is much more than a database. The Hub has the capacity to power other platforms and databases such as the mindful MATERIALS Library. Each powered platform offers a curated subset of data found on Origin. Manufacturers can participated in powered platforms without re-entering their material data - materials can be directly connected to powered platforms. Updates which manufacturers make to their materials in Origin appear in all Origin-powered platforms.
How is the order of search results determined?
Origin’s search algorithm considers the information completeness of materials. Materials with the most relevant and complete data, appear first in search results. Suppliers cannot pay to boost the search ranking of their materials.
How can I refine my searches?
You can start your search by typing keywords into the header search bar, or by selecting filters from the left sidebar. To refine your search, select filters from the left sidebar. Each selected filter will refine both the product search results and the available search filters. Search filters that will not return content are not displayed. As you narrow your search, fewer search filters will be available.
Who owns the data on Origin?
Users create data. Data belongs to the Company of its creator. No other User or Company can manipulate data without the consent of the data creator. Please refer to our Terms and Conditions for more details. At their sole discretion, data creators can publish or un-publish their content.
What Browsers does Origin Support?
Origin is optimized to work using the following browser configurations:
Note that Microsoft suspended its support of all versions of Internet Explorer (IE) on January 12, 2016. Origin is no longer optimized to work using IE.
In what geographies is Origin available?
Origin is available worldwide, anywhere with an internet connection. Our data collection efforts are primarily focussed on the North American and Chinese markets.
What languages does Origin support?
The Origin platform is currently available in English, Chinese, French and German. Platform titles, prompts and tools are available in these languages. Material and Certification content is available in the language/s that are submitted by those who create data.
How can I contact the Origin Support Team?
At the bottom right hand of your browser you will see a black tab. On it, you will see the words, “Click here for help”. To contact Origin’s Support Team, click the tab. A pop-up form will appear. Within the form, add the subject of your question and a message describing the problem you’re experiencing. Click the “Submit” button at the bottom right of the form. Your message will be sent to the Origin Support Team and you should receive an automatic email confirming they’ve received your note. We’ll be in touch as quickly as possible.
What is the relationship between mindful MATERIALS & Origin?
In 2017 mindful MATERIALS partnered with GIGA to move its Google spreadsheets to a cloud database, creating a more efficient way for manufacturers to share product information and for AEC users to access it. Origin has transformed the way AEC professionals identify and search for products across brands, product categories, and certifications. It also has allowed for direct integration with multiple Reporting Bodies.
The mindful MATERIALS Library is a custom portal powered by GIGA technology, the Origin Material Hub. Origin guarantees that the mindful MATERIALS Library will ALWAYS BE FREE for manufacturers to upload material data and for industry professionals to search and view material data. Since 2017, GIGA has powered the mindful MATERIALS Library, pro bono.In collaboration with the mM Portal Working Group, GIGA develops feature advancement and engages user feedback to help guide the usability, accessibility and relevance of the platform.
Do materials appear in the mindful MATERIALS Library immediately after they are published to Origin?
No! Prior to being listed in the mindful MATERIALS Library, Manufacturers must request that a review from the mM Review Team. Only materials that have been reviewed are published to the mM Library. The review is required to check that the product meets the baseline criteria for entry and that submitted materials are matched with correct and current certification information. Approved materials are automatically added to the mM Library, there's no need to re-enter information. Any further product updates that are made in the Origin account will be directly reflected in the mindful MATERIALS Library.
Can Distributors publish to the mindful MATERIALS Library?
For Distributors to publish content to the mindful MATERIALS Library on behalf of manufacturer requires prior approval from manufacturers. Distributors must request that a representative from their manufacturing partner/s send our Support Team an email (firstname.lastname@example.org) to authorize Distributors to create and manage content on their behalf. Manufacturer representatives must have an email that matches the corporate domain of the manufacturing company.

Our Mission.Our mission is to enable regenerative, high-performance buildings by providing access to unbiased, comprehensive and accurate material information. Origin provides the construction industry with an ecosystem that enables information exchange between Manufacturers and Reporting Bodies (Data Owners) and A+D, consultants and specifiers (Data Users). Built as a connected data hub, Origin collects material information directly from Data Owners, normalizes it, and makes it available to Data Users, and also to 3rd party tools and services. By connecting directly to data sources, Origin receives updates from the data source helping to reduce data management while keeping data current. As Origin connects to each data source, we move one step closer to eliminating ‘dead’, out-of-date data. By connecting to data sources, Origin also significantly reduces data maintenance costs enabling all Users to benefit from free usage of all basic features.
Origin is built to connect Data Owners, Data Users, and 3rd Party platforms and tools. Origin provides API Services to enable data flow between Data Exchange Partners. Free API Services are available allowing 3rd Parties to use data to create tools and services that support industry engagement in Origin’s hub ecosystem. Usage of data from Origin is defined below and includes limits. These limits are not meant to restrict competition and have been created both for technical reasons and to create a level playing field. Our API Services are further described below. This document establishes the Guiding Principles, upon which Origin is built, and the Terms & Conditions for use of Origin’s services.
A Connected Solution. Origin was built from need: good material information is hard to find. Construction industry data sources are generally fragmented and inconsistent. Material information requirements vary per project type, building code, green building standard, and personal preference. The diversity of requirements exponentially multiplies the number of requests which Manufacturers and Reporting Bodies receive, where they provide their information, and how it is provided. It is difficult (and unrealistic) for Manufacturers and Reporting Bodies to respond to all industry requests and continually send updates to those who request information. Origin enables the diversity of these requests to be answered without fragmenting material information. Data Owners can use Origin directly or connect their preferred data management platforms to Origin. Once a Data Owner’s data is on Origin, it can be shared with any connected Data Exchange Partners, at the Data Owner’s sole discretion. This process and overall ecosystem helps streamline Data Owners’ content management efforts while ensuring material information remains relevant for Data Exchange Partners.
Facts are Free. As a core principle, facts are free on Origin. Manufacturers and Reporting Bodies are not charged to add or connect their product data to Origin. Similarly, Origin users and Data Exchange Partners are not charged to search and view this data. Facts are provided for free to remove bias and to ensure the entire industry can participate. Origin will provide Data Owners with aggregate usage statistics and analytics to ensure that material information continues to flow. By removing paywalls and providing aggregate feedback, we are incrementally building collective demand for living data.
Origin makes money from optional subscriptions to premium analytics packages, premium features and API Services which exceed the free limits defined below. These optional fee-based services are not covered in the below Terms and Conditions. Importantly, these optional packages do not impact access to data and facts - facts will always be free on Origin.
GUIDING PRINCIPLESOrigin’s development and evolution are continually guided by the following principles:
API Services enable data exchange between Origin and Data User applications. Both Import and Export API Services are available to Data Exchange Partners. Access to Our API Services is provided at Our sole discretion. Data Exchange Partners can exchange data with Origin using any of the following ways:
Connected Data related import/export servicesConnected Data related API services provide synchronous, on-demand data exchange allowing Data Exchange Partners to import/export a single aggregated Entity per API call. Connected Data related API Services also provide Data Exchange Partners with access to search related services and search results. Disconnected Data related import/export servicesDisconnected Data related API Services provide asynchronous data exchange. Disconnected Data related API Services allow Data Exchange Partners to import/export multiple aggregated Entities per API call.
Building Standard Software refers to software applications which support building codes and green building programs. Examples include, but are not limited to, LEED Online and the WELL Workstation.
Company refers to an organization which has registered to use Origin. Each Company may have one to multiple registered users. Only credentialed registered users can access a Company account.
Connected Data refers to data which is exchanged on demand (synchronously) between Data Exchange Partners and Origin and can be accessed in any of the following ways:
Data Owners may track the aggregate usage of their Connected Data.
Data Exchange Partners refers collectively to Companies that use Our API Services to exchange data on Origin. This includes Data Owners and Data Users.
Data Owners refers to Manufacturer and Reporting Body Companies which create their data in Origin, and Data Exchange Partners who use Our Import API Services to connect their data to Origin.
Data Users refers to Reporting Body Companies, 3rd Party Companies and Data Exchange Partners which consume Our Export API Services.
Disconnected Data refers to Public Data which is downloaded by Data Users. Disconnected Data is shared asynchronously and requires periodic updates to remain current. Disconnected Data is downloaded by Data User applications in bulk and can be used, reused, reformatted or redistributed at the sole discretion of the Data User. Data Owners cannot track the usage of their Disconnected Data once it has been downloaded by a Data User application.
Entity refers to a unit of data added by Data Owners that can be classified/organized and has defined relationships to other Entities. The following Entities can be made available to be shared with Data Users at the sole discretion of Data Owners: a material, a certification, or a document. Each Entity can include a set of information. Material Entities refer to texts, images, files, certification details, sustainability and performance attributes, SKUs, tags, contacts, and other structured data. An Entity is represented by a name and an ID.
Integration Partners refers to Companies and/or Users which use Origin API Services.
Manufacturer refers to Companies which produce, sell and/or distribute building materials.
Private Data refers to any content which has been not been published by Data Owners.
Procurement Tools refer to software applications that facilitate the specification and/or purchase of building materials and/or products and related services.
Public Data refers to any content which has been published by Data Owners.
Reporting Body refers to Companies which review, audit and/or certify materials, material components and/or material attributes.
Self-Serve refers to services provided by Origin which are intended for use without the direct support of Origin directors, staff or consultants.
TERMS & CONDITIONS FOR USE OF ORIGIN’S STANDARD SERVICESOrigin is a cloud-based application for the construction industry. Origin can be used by the general public, or by Registered Users. This document sets forth the general principles upon which we make available Origin Services to Public and Registered Users. We reserve the right to amend this document from time to time, at our discretion, without notice.
Products and Services provided under the name “GIGA”, “GIGABASE” or “Origin” are provided by GIGABASE Inc., a company incorporated under the applicable laws of Canada and its provinces (all references herein to “We”, “Origin”, “GIGA” or “GIGABASE” shall mean GIGABASE Inc.). These Terms and Conditions for use of Origin’s Standard Services (“Terms and Conditions”) constitute a contract between You, as a user, and GIGA when You use Origin’s standard provided sites, Services, and Products (“Services”). If You are a paid subscriber to Origin Products and/or Services please refer to the Terms and Conditions of Use of Your service Agreement.

Access to certain Services are only available for use by users who enter into a binding contract with GIGA, and only in compliance with these Terms and Conditions and all applicable laws.
When You create an account, You must provide accurate information to use the Services, in particular, your email address. Failure to do so may result in suspension or termination of Your account.
We recommend that You use strong passwords to access Your account. You are responsible for safeguarding the password that You use to access the Services and for any activities or actions that occur when Your account is accessed with Your password. GIGA will not be liable for any loss or damage arising from the misuse of Your password.
The Services are optimized for use with the following browser configurations:
The Services may also work with other browser configurations, however We recommend that You use one of the above configurations when accessing the Services.
If You create an account on behalf of a company, organization, or other legal entity, then (a) ”You”, the user, includes yourself and that legal entity; jointly, and (b) You represent and warrant that You are authorized to bind the legal entity so it agrees to these Terms and Conditions as well.
Some of the Services may be software that is downloaded to your computer, phone, tablet, or other device. You agree that We may automatically upgrade those Services, and these Terms and Conditions will apply to such upgrades.
We may, without prior notice, change the Services, cease supply of the Services or features of the Services to You or other users generally, or create usage limits for the Services.
Subject to these Terms and Conditions and related Privacy Policies (https://origin.build/#/terms), We grant You a limited, non-exclusive, non-transferable, and revocable license to use the Services.
2. Your Content2.1 Uploading Your Content.GIGA allows You to upload content to the Services, including images, documents, comments, and other materials. Anything that You upload or otherwise make available while using the Services is considered “Your Content”. You retain all rights in, and are solely liable for the accuracy of Your Content that Your upload(s) to the Services. You agree, to the best of Your abilities, to keep Your Content accurate and current.
By uploading Your Content, You represent and warrant that You are the owner of such content, including any intellectual property rights in such content, or that You are authorized by the owner to use it, and that such content is accurate, not misleading, not illegal and does not contain subjective views that may be considered defamatory or disparaging of another person, product or service. If You are in doubt that any content You propose to upload complies with this Section, You shall not upload it.
You agree that GIGA shall have the right to edit, remove or block access to Your Content without notice for any reason, including content that GIGA believes, in its sole discretion, to breach these Terms and Conditions, related Privacy Policies or any applicable laws or regulations.
When You Publish Your Content on Origin, you agree that it may be viewed by any authenticated or unauthenticated Origin User. You also agree that Your published Content may be accessed by Integration Partners through Origin’s Export API Services in accordance with section 4 below.
You further agree to indemnify and hold harmless GIGA against any claims arising from Your Content uploaded by You in breach of these Terms and Conditions and/or applicable laws or regulations.
2.2 How GIGA and other entities can access and use Your Content.
At Your sole discretion, You may publish Your Content to the Services. By publishing Your Content, You grant GIGA and other entities an irrevocable, non-exclusive, royalty-free, worldwide license to access use, store, display, Your Content solely for the purposes of operating, developing, providing and using the Services. GIGA may integrate the Services with third party software providers (“Integration Partner/s”). By default, Your account shall be opted-in to share Your Public Data with Integration Partners, at our sole discretion, as Connected and/or Disconnected Data. You may opt out of this default setting, at any time, within the Services. You may also revoke sharing Your Public Data with each Integration Partner the Services are connected to. Notwithstanding anything to the contrary, GIGA shall have the right collect and analyze data and other information relating to the provision, use and performance of various aspects of the Services and related systems and technologies (including, without limitation, information concerning Your Content and data derived therefrom), and GIGA will be free to (i) use such information and data to improve and enhance the Services and for other development, diagnostic and corrective purposes in connection with the Services and other GIGA offerings, and (ii) disclose such data solely in aggregate or other de-identified form in connection with its business. No rights or licenses are granted except as expressly set forth herein.
2.3 Your Feedback.We value your feedback. Your feedback helps us to optimize the Services for your use. If You provide comments, ideas or other feedback, You agree that GIGA is free to use them without any restriction or compensation to You.
2.4 Termination and Deletion.Where Your account is terminated, deactivated, blocked or You delete in whole or in part Your Content from the Services, We may nevertheless retain Your Content for a commercially reasonable period of time for backup, archival or audit purposes. Furthermore, GIGA, its users and Data Exchange Partners may retain copies of and continue to use, store, display, and/or re-post, any of Your Content that has been shared with Your consent, through the Services.
3. SecurityThe security of Your Content is a priority. While We work towards this goal, GIGA cannot guarantee that unauthorized third parties will not be able to breach the Services’ security measures. Please notify GIGA immediately if You become aware of any suspicious activity or any incident that compromises or constitutes unauthorized access to or use of your account.
4. API Services4.1 Import API Services.
Access to Our Import API Services is only provided to users who are approved at Our discretion (“API Users”). API Users may be approved to use Our Import API Services to provide content to Origin (“Import API Users”), and/or Our Export API Services to use content from Origin (“Export API Users”). Prior to accessing to Our API Services, API Users must agree to the Terms and Conditions herein. We reserve the right, at our sole discretion, to disable or terminate the API Services provided to any API User who breaches the Terms and Conditions herein. API Users may access Our Import API Services and Export API Services (collectively, “API Services”). All API Service Users shall be provided with documentation to enable the use of Our API Services. All API Users are subject to usage limits as defined herein. We may publicly disclose Our relationship with any user of Our API Services. Data Owners fully control their Entities. At their sole discretion, Data Owners determine which of their Entities are published, which of their published Entities are shared, with which Data Exchange Partners their published Entities are shared, and how their published Entities are shared. Data Owners may also export their Entities from Origin, to commonly used spreadsheet formats, at their sole discretion. Our API Services may be used according to the Terms and Conditions herein.
Data Owners may make their published Entities available to Data Exchange Partners using Connected Data services or Disconnected Data services.
Our Import API Services allow credentialed Data Owners to connect their Entities to Origin.
Accredited Data Owners may import their Entities into Origin by connecting to Our Import API Services. Origin’s Self-Serve API Services are provided free of charge. If Users of Our Import API Services are unable to connect their Entities to Our Import API Services, it is possible, at our sole discretion, to pursue alternative import methods. These alternative import methods shall be negotiated individually with each user of Our Import API Services and may incur fees. Whenever a Data Owner’s Origin account expires or is terminated, he/she will lose access to all of Our API Services. If a Data Owner’s Origin account is terminated he/she will have 15 days to export his/her Entities following termination.
Each day, users of Our Import API Services may create Entities without limit. If Your amount of daily updates significantly exceeds 20% of the total number of Your Entities, we reserve the right to immediately disable your import capacities, or throttle Your account until Your import capacities is reduced. We reserve the right to impose an appropriate fee commensurate with such excess usage. There are no limits to the number of Entities which are stored on Origin. There are limits to the total amount of storage which is allotted to each Company, and limits to the size of individual files that are uploaded to each Entity:
4.2 Data and Analytics We provide to Import API UsersWe will provide Import API Users with bi-annual, aggregate feedback that may include the following:
A User’s personal information, including but not limited to names, titles, email addresses, and phone numbers will not be shared without his or her permission.
License subscriptions for additional usage data and analytics including, information specific to Your Company and aggregate geographical statistics, may be purchased at Your sole discretion.
4.3 Use and Sharing of Your ContentWe reserve the right to use Your Content in the following ways:
4.4 Export API ServicesOur Export API Services are provided to credentialed and whitelisted users. Published Entities received through our Export API Services are provided as Connected Data or Disconnected Data. Published Entities are made available to each Export Data User at the sole discretion of their Data Owners. Data Owners may opt to share their published Entities as Connected Data, or Disconnected Data, at their sole discretion. Only published Entities which have been shared by Data Owners shall be accessible through Our Export API Services.
4.5 Data and Analytics We provide to Export API UsersWe will provide Export API Users with regular, aggregate feedback that may include the following:
4.6 Exporting Your EntitiesAt Your sole discretion, You may export Your Entities from Origin, including both public and private Entities. Each day, You may export 1,000 Your Entities. Please contact Our Support Team (email@example.com) if increased export limits are needed.
4.7 Connected and/or Disconnected Data API ServicesCredentialed Data Users who use Our Connected and/or Disconnected Data Services agree to be bound to the Terms and Conditions herein.
4.8 Connected and/or Disconnected Data Usage LimitsIf the number of exported Entities significantly exceeds the average exported Entities (as determined solely by us) of other data partners, we reserve the right to immediately disable your export capacities, or throttle your account until Your export usage is reduced. We reserve the right to impose an appropriate Fee commensurate with such excess usage.

4.9 Restricted UsesIf You generate suspicious activity, We reserve the right to monitor Your transactions and bandwidth utilization to validate that Your usage of the Services is in compliance with the terms established in this Agreement. At Our sole discretion, We reserves the right to audit Your usage of the Services to validate that Your usage complies with the Terms and Conditions herein. The timing, scope, method and duration of each audit shall be determined at Our sole discretion. Each audit may be conducted without prior notice and without Your consent. Should an audit reveal Your usage of the Services is in breach with the Terms and Conditions herein, We may:
Connected and/or Disconnected Data Users are strictly prohibited from making copies, reusing, reformatting and redistributing any content received through Origin’s Connected and/or Disconnected Data services.
If You generate suspicious activity, We reserve the right to deploy queuing mechanisms to validate that Your usage of Our API Services is in compliance with the terms established in this Agreement. At Our sole discretion, We reserve the right to audit Your usage of Our Connected and/or Disconnected Data Services to validate that Your usage complies with the Terms and Conditions herein. The timing, scope, method and duration of each audit shall be determined at our sole discretion. Each audit may be conducted without prior notice and without Your consent. Should an audit reveal Your usage of Our Connected and/or Disconnected Data services is in breach with the Terms and Conditions herein, We will:
5. Copyright PolicyGIGA respects the intellectual property rights of others and expects users of the Services to do the same. We will respond to notices of alleged copyright infringement that comply with applicable laws and are properly provided to GIGA. 6. Third-Party LinksThe Services may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by GIGA. We do not endorse or assume any responsibility for any such websites, information, content, materials, products, or services. If You access any third party website, service, or content through the Services, You do so at your own risk and You agree that GIGA will have no liability arising from your use of or access to any third-party website, service, or content.
Personal information that can identify an individual user are usually not contained in cookies, however; personal information that We store about You may be linked to the information obtained from and stored within cookies.
8. Disclaimers, IndemnityThe Services are provided from services located in Japan and We give no representations or warranties that they are appropriate for use in other locations.
If You use the Services, You agree to indemnify and hold harmless GIGA and its officers, directors, employees, partners and agents, from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including, without limitation, reasonable legal and accounting fees (including costs of defense of claims, suits or proceedings brought by third parties), in any way related to (a) Your access to or use of the Services, (b) Your Content, or (c) Your breach of any of these Terms and Conditions, including without limitation liability for Your Content.
To the maximum extent permitted by applicable law, GIGA and its officers, directors, employees, partners and agents disclaim any warranties, express or implied, of merchantability, fitness for a particular purpose, or non-infringement. We make no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability of the Service or any content thereon. GIGA will have no responsibility or liability for the deletion of, or the failure to store or to transmit, Your Content hosted by the Services. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from GIGA, its officers, employees or agents, or through our products, will create any warranty not expressly made herein.
To the maximum extent permitted by applicable law, GIGA and its officers, directors, employees, partners and agents will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not GIGA has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
9. Governing Law, Language and Legal DisputesThese Terms and Conditions and the use of the Services shall be governed by the applicable laws of Canada and its province of Ontario without regard to principles of the conflicts of laws.
These Terms and Conditions are in the English language and where they are translated into other languages, the translation shall be for reference only. If there is any inconsistency between the English version and translated versions, the English version shall prevail and no reference shall be made to any translated versions to interpret the English.
You and GIGA agree that any claim or dispute arising out of the use of the Services and the application of these Terms and Conditions shall be resolved in accordance with this section unless You and GIGA otherwise agree in writing. Any claim or dispute shall first be discussed between You and GIGA in good faith to achieve an amicable resolution.
If an amicable resolution cannot be reached within sixty (60) days of the date either You or GIGA first raised the claim or dispute in writing, either party may submit its claim or dispute to the exclusive jurisdiction of the courts of Ontario, Canada.
10. General TermsGIGA reserves the right to determine the form and means of providing notifications to You, and You agree to receive legal notices electronically if We so choose. We may revise these Terms and Conditions from time to time and the most current version will be deemed the one published on GIGA’s commercial website at any relevant time. If a revision, in GIGA’s sole discretion, is material We will notify You. By continuing to access or use the Services after revisions become effective, You agree to be bound by the revised Terms and Conditions. If You do not agree to the published Terms and Conditions at any relevant time, please stop using the Services.
11. Term & TerminationThis Agreement is effective from the date that You first access the Services or submit any information to GIGA, whichever is earlier, and shall remain effective until terminated in accordance with its terms. Certain violations of this Agreement, as determined by GIGA, may result in immediate termination of this Agreement, and/or Your access to and use of the Services, without prior notice. This Agreement will also terminate automatically if You fail to comply with any term or provision of this Agreement, with no cure period. Upon termination of this Agreement by either Party, Your right to use the Services shall immediately cease, and You shall destroy all copies of information that You have obtained from the Services, whether made under the terms of this Agreement or otherwise. All disclaimers, limitations of liability, indemnities, GIGA rights of ownership, and licenses to GIGA shall survive any termination, indefinitely.
We reserve the right at any time and from time to time to modify, discontinue, temporarily or permanently, the Services, or any part or portion thereof, with or without notice to You. You agree that We shall not be liable to You or to any third party for any modification, suspension or discontinuance of the Services, or any part or portion thereof. Nothing in this Agreement shall be construed to obligate GIGA to maintain and support the Services, or any part or portion thereof, during the term of this Agreement.

You can use The Services in many ways. You can search for information, communicate with other GIGA Users, create Your Content, or opt to share it. When You share your Content with us, for example by creating your account, We can continually improve our tools and services – to show You more relevant materials or projects, to help You connect with like-minded professionals or to make managing and sharing Your Content quicker and easier. As You use The Services, we want You to clearly understand how We may process Your Content and how You can manage and protect its privacy.
Information GIGA may collect
We collect information to provide better services to all of our users – from letting You choose whether to communicate in English, Chinese, French or German to more complex things like which materials You’ll find most useful or the brands which matter most to You.

To sign up for an account, We’ll ask for information that may be personal (sometimes defined as Personally Identifiable Information or PII), like your name, email address, telephone number, job title, employer and location. You agree to provide valid and accurate information and have access to functionalities allowing you to update this information to keep it current.
When You join GIGA, as permitted by applicable laws, You are specifically “opting in” in order to receive emails from Us about your account or about GIGA. You can manage your email and notification preferences in your account settings, but note that You cannot “opt out” of receiving certain administrative or legal notices from Us. If you do not want to receive these administrative or legal notices, You should NOT join GIGA or You should immediately close your account. If You exchange messages with others through the Site, in accordance with applicable laws, We may store them in order to process and deliver them, allow You to manage them, and investigate possible wrongdoing in connection with the Site. This is for your protection. GIGA may also enable You to connect, at your initiation, outside the Site and via the email address you provide to third-party providers of products and services who You wish to contact.
Information we collect through your use of The Services
GIGA may collect the following information when You use The Services:

We may use the information we collect from The Services to provide, maintain and improve them, to develop new ones, and to protect GIGA and other users. We may also use this information to offer content tailored uniquely for You.

When You contact GIGA, we may keep a record of your communication to help troubleshoot and solve any issues You might be facing. We may use your email address to notify You about The Services, such as letting You know about upcoming changes or improvements.
We may use information collected from persistent and non-persistent cookies and other similar technologies to improve your overall user experience and the total quality of The Services. For example, by indicating your language preferences, we can deliver The Services in the language You prefer, each time you connect and without asking You for this preference every time. These are persistent information details kept by GIGA for the sole purpose of making your user experience more convivial and personal.
GIGA processes Your Content on servers in various locations around the world. We may process your personal information on a server located outside the country where You live or use The Services from. At all times, Your Content benefits from the same rigorous protection; notwithstanding its location.
Transparency and choice
The Services use a limited and documented set of persistent ‘cookies’ to give You the best, most relevant user experience. Non-persistent cookies are also used each time you connect to The Services but are automatically deleted when you disconnect from The Services. GIGA strongly recommends You always end a connection to The Services through the “Log Out” process. Closing a browser window does not automatically end your access to The Services. Following the authentication in Origin, the logged-in user is assigned a valid token for a duration of 10 hours. Once the token expires, users will be logged-out and will be requested to re-authenticate. Using The Services means You agree with this. You may set your browser to block all cookies, including cookies associated with The Services, or to indicate when a cookie is being set by Us. However, remember that many of The Services may not work properly if You deny these cookies from being set on your computer.
Subject Access Requests
You can always submit a request to GIGA to ask what information We collect and how We process it. This request should be sent to GIGA’s Data Protection Officer (see below for contact information). When You do, GIGA will provide You with the following information, within 30 days of your request and at no cost to You:
Information You share
The Services allow You to share Your Content with other users. Remember that when You share information publicly, it will be available to authenticated and non-authenticated users of Origin. The Services provide You with different options for sharing and removing Your Content. Please check your account settings for these options.
Accessing and updating your personal information
Whenever You use The Services, the goal is to provide You with access to Your Content. If that information is wrong, we strive to give You means to update it quickly or to delete it – unless we have to store that information for legitimate business or legal purposes. When updating Your Content, we may ask You certain questions to verify your identity before we can act on your request.
We may reject requests that are unreasonably repetitive, require disproportionate technical efforts or would constitute a reasonable risk to the privacy of users.
Where We will provide You with information access and update privileges, We will do so at no charge, except where it would require a disproportionate effort and We have agreed on specific fees with You. We strive to maintain The Services in a manner that protects Your Content from accidental or malicious destruction. Therefore, after You delete Your Content from The Services, We may not immediately delete residual copies from our active servers and may not remove Your Content from the backup systems but this residual information, as long as it is with GIGA, will continue to benefit from the same rigorous protection.

We do not share Your Content unless any of the following circumstances apply:

Such information is NOT Your Content as it was ‘’sanitized’’ in a demonstrable way to remove any information that can identify you amongst users. We follow generally accepted industry standards to protect Your Content, both during transmission and once We received it. However, no methods of transmission over the Internet or via mobile devices, or methods of electronic storage, is 100% secure – so We do not guarantee its security.
